Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Khushu ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App. These Terms form a legally binding agreement between you and Talha Malik ("we", "us", "our").

These Terms incorporate Apple's standard End User Licence Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula. In the event of a conflict, Apple's EULA takes precedence.

2. Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on any Apple device you own or control, solely for your personal, non-commercial purposes, subject to these Terms.

You may not:

• Copy, modify, or distribute the App or any portion of it
• Reverse engineer, decompile, or attempt to extract the source code
• Use the App for any unlawful purpose
• Attempt to circumvent the app-blocking functionality in a manner that violates Apple's platform policies

3. Subscriptions and Billing

Khushu is available on a subscription basis. By subscribing, you agree to the following:

• Free trial: New subscribers receive a 3-day free trial. The trial begins when you confirm your subscription. If you do not cancel before the trial ends, you will be charged.
• Billing: Subscriptions are billed through your Apple ID account at the confirmed price. The billed amount is displayed clearly before you confirm purchase.
• Auto-renewal: Your subscription automatically renews at the end of each period unless you cancel at least 24 hours before the renewal date.
• Cancellation: You can cancel at any time through your Apple ID settings (Settings → [Your Name] → Subscriptions). Cancellation takes effect at the end of the current billing period — you retain access until then.
• Refunds: All refund requests are handled by Apple in accordance with their refund policy. We do not process refunds directly.
• Price changes: We may change subscription prices with reasonable notice. Continued use after a price change constitutes acceptance of the new price.

4. Screen Time and App Blocking

Khushu uses Apple's Screen Time API (FamilyControls framework) to block apps you select during prayer windows. By using this feature, you acknowledge that:

• App blocking is a tool to support your intentions — it is not a guarantee of prayer completion
• You are responsible for granting and managing Screen Time permissions
• We are not liable for any consequences arising from blocked apps, including missed messages, calls, or notifications during a prayer window
• This feature requires iOS 16 or later and explicit permission granted by you

5. Location Services

Prayer time calculation requires your location. By granting location permission, you acknowledge that your approximate coordinates are used to fetch prayer times from the Aladhan API. This data is not stored by us. You can withdraw location permission at any time in iOS Settings, which will disable prayer time functionality.

6. Disclaimers

The App is provided "as is" without warranties of any kind. We do not guarantee that:

• Prayer times calculated by the App are perfectly accurate for all schools of thought and locations
• The App will function without interruption or error
• App blocking will prevent access to all content on blocked apps in all circumstances

Prayer times are based on standard astronomical calculations. Always verify critical prayer times with a local mosque or authoritative source.

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms limits liability for death, personal injury, or fraud caused by our negligence, or any other liability that cannot be excluded under applicable law.

8. Intellectual Property

All intellectual property in the App — including its name, design, code, and content — belongs to us or our licensors. Nothing in these Terms transfers any intellectual property rights to you.

9. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer protection laws in your country of residence provide otherwise.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via an in-app notice or updated date on this page. Continued use of the App after changes constitutes acceptance of the revised Terms.
